يعتبر الشغل أحد المواضيع المهمة المندرجة تحت مفهوم " الإجتماعي"، حيث تنظر إليها المجتمعات كإحدى الأولويات في تخطيطاتها. إذ تؤثر على الناحية الإقتصادية والإجتماعية من خلال الإستقرار الناتج عن إيجاد دخل قار لطالب الشغل. ومن هذا المنطلق أصبح هذا الموضوع تتقاطعه كل اهتمامات المشرع والقضاء والفقه من خلال صورة الرابطة القائمة بين الأجير والمشغل.

وبين مقتضيات الفقه الإسلامي والإتفاقيات الدولية في هذا المجال تعمل منظمة العمل الدولية على توحيد تشريعات الشغل، باعتبارها الإطار المثالي لتوحيد التشريعات الإجتماعية على الأقل من الوجهة النظرية. إذ بعد أن كان العمل مجرد عامل بسيط من عوامل الإنتاج -خاصة عند مؤسسي النظرية الليبرالية-، انتهى به المطاف ليصبح خاصية انتروبولوجية؛ أي خاصية إنسانية وماهية وجدت مع الإنسانية. الأمر الذي يفرض احترام الضمانات الحقوقية للطبقة الشغيلة في كل الأنظمة والقوانين وعلى أرض الواقع.

Employment is considered one of the important issues under the concept of "social", as societies view it as one of the priorities in their planning. It affects the economic and social aspects through the stability resulting from the creation of stable income for the job seeker. From this point of view, this topic has become intersected by all the concerns of the legislator, the judiciary, and jurisprudence, through the image of the bond existing between the employee and the employer.

And between the requirements of Islamic jurisprudence and international agreements in this field, the International Labor Organization works to unify labor legislation, as it is the ideal framework for unifying social legislation, at least from a theoretical point of view. After work was just a simple factor of production - especially for the founders of liberal theory - it ended up becoming an anthropological characteristic. Any human characteristic and essence found with humanity.

This imposes respect for the human rights guarantees of the working class in all regulations and laws and on the ground.
