التحكيم في منازعات الإستثمار بين القواعد التقليدية والحديث

غالبا ما يتم إبرام الإستثمار بين تربط الدول والشركات متعددة الجنسيات التي تمتلك الرأسمال والمقدرات التكنولوجية والمهارات الإدارية، وبين الدول النامية التي تمتلك الموارد الطبيعية والقوى العاملة الأقل كلفة. ولأجل ذلك تقدم هذه الأخيرة ضمانات قضائية تتمثل في الوسائل البديلة لتسوية منازعات الإستثمار.

ويرجع سبب هذا التوجه إلى أزمة الثقة بين المستثمر الأجنبي والقضاء الرسمي في الدولة المستضيفة له. ويلعب التحكيم في منازعات الإستثمار دورا رائدا لكونه يواكب خصوصيات الإستثمار من جهة، ولما توفره قواعده العالمية من امتيازات.

وفي المغرب، وما بين عام 2007 التي عرفت خروج النسخة الأولى من القواعد القديمة المنظمة للتحكيم، وعام 2022 حيث خرجت القواعد الحديثة للقانون المستقل المنظم له، نتساءل عما إذا كانت هذه القواعد الحديثة للتحكيم تضمن جذب الإستثمار واستقراره، وتستطيع رفع تحدي التنافسية العالمية، والفاعلية المرجوة لتسوية منازعات الإستثمار؟.

Investment is often concluded between connecting countries and multinational companies that possess capital, technological capabilities, and managerial skills, and developing countries that possess natural resources and the lowest-cost workforce. For this reason, the latter provides judicial guarantees represented in the alternative means of settling investment disputes.

The reason for this trend is due to the crisis of confidence between the foreign investor and the official judiciary in the country hosting him. Arbitration in investment disputes plays a pioneering role because it keeps pace with the specifics of investment on the one hand, and the privileges provided by its international rules.

In Morocco, between 2007, when the first version of the old rules regulating arbitration came out, and 2022, when the modern rules of independent law regulating it came out, we wonder if these modern rules of arbitration guarantee investment attraction and stability, and can raise the challenge of global competitiveness and the desired effectiveness. To settle investment disputes?.
