بدافع حاجة المستهلك لتلبية متطلباته الشخصية والعائلية من جميع المنتجات والخدمات الضرورية للعيش، يضطر إلى ضرورة اللجوء إلى إبرام تعاقدات مع مهنيين متمرسين ومتمكنين من خفايا أنشطتهم، مما يجعله في غالب الأحيان يلتزم بمضمون عقد لا يفقه في بنوده شيئا، ويخضع لالتزامات لا يعرف عنها إلا نزر قليل، ذلك أن أميته تحول دون تمكنه من معرفة ماله من حقوق وما عليه من التزامات في أحايين كثيرة.
