ملخص المقال باللغة العربية:

 إن إنشاء بنية اقتصادية جديدة كخيار يمكن من خلاله تنظيم المجتمع بشكل مختلف، موازاة مع التقدم الذي يحرزه في مجال التقنيات الرقمية، وما يمكن أن تعنيه للجنس البشري. خاصة في مجال بناء الحلول الرقمية عبر تشريع محكم ومنظم لما يجب أن تكون عليه المعاملات.

 وهكذا كانت العقود الذكية التي تبرم على التقنية الرقمية "البلوك تشين" الحل الرقمي للمشاكل التي يعرفها التعاقد بصفة عامة. وساهمت في استقرار العلاقات التعاقدية وبالتالي حماية الأمن التعاقدي. إلا إنه ثارت بشأنها مجموعة من الإشكالات الفقهية أهمها ما ارتبط بماهيتها، أي هل هي كيان قانوني مستقل يغني عن العقد الأصلي. وبالتالي يمكن اعتبارها جيلا جديدا من طرق إبرام العقود، أو أنها مجرد إجراء الكتروني صاحب العقد التقليدي ليدخله عالم العصرنة والتطور التقني. وما نتج عن ذلك من ثورة على نظرية العقد عموما والإذعان، واستفادت من النظريات الجديدة في مجال المسؤولية المدنية، كنظرية المخاطر والضمان.

Article summary:

The creation of a new economic structure as an option through which society can be organized differently, parallel to the progress it is making in the field of digital technologies, and what it can mean for the human race. Especially in the field of building digital solutions through tight and regulated legislation of what transactions should be.

Thus, smart contracts concluded on the digital technology "Blockchain" were the digital solution to the problems known to the contract in general. It contributed to the stability of contractual relations and thus the protection of contractual security. However, a set of jurisprudential problems arose about it, the most important of which was related to its nature, that is, is it an independent legal entity that dispenses with the original contract. Thus, it can be considered as a new generation of ways of concluding contracts, or it is just an electronic procedure for the owner of the traditional contract to enter the world of modernity and technical development. The resulting revolution in the theory of contract in general and compliance, and benefited from the new theories in the field of civil liability, such as the theory of risk and warranty.
